Arizona Homestead Exemption: Rules & Savings

Arizona law reviewed August 25, 2026

Arizona Homestead Exemption 2026: $437,600 Equity Protection, Rules & Real Savings Options

Arizona’s homestead exemption protects a qualifying Arizona resident’s equity in the home they actually live in from many judgment-creditor collection efforts. For 2026, the inflation-adjusted exemption is $437,600.

The protection is automatic—most homeowners do not file a homestead application or declaration. But an equally important point is that Arizona’s homestead exemption is not a general property-tax discount. If your goal is to lower property taxes, Arizona uses separate programs such as Senior Property Valuation Protection and individual exemptions for certain widows, widowers, disabled persons and disabled veterans.

Arizona Homestead Exemption Protects Home Equity—It Does Not Lower Everyone’s Property Tax

Arizona uses the phrase “homestead exemption” very differently from states such as Texas or Florida. Knowing which benefit you need prevents you from searching for a property-tax form that does not exist.

A.R.S. §33-1101

Arizona Homestead Exemption

  • Protects qualifying home equity from many creditors.
  • 2026 amount: $437,600.
  • Usually automatic.
  • No ordinary annual application.
  • Can protect identifiable sale proceeds temporarily.
  • Does not itself reduce assessed property value.

2026 Current Amount

How Much Is the Arizona Homestead Exemption in 2026?

The 2026 Arizona homestead exemption is $437,600. The statute contains a $400,000 base and requires an annual cost-of-living adjustment every January 1 using the CPI-U for August of the immediately preceding year compared with August one year earlier.

$400,000 Statutory base established by Proposition 209.
$425,200 2025 inflation-adjusted amount under the statutory calculation.
+2.9% August 2024 to August 2025 CPI-U increase.
$437,600 2026 amount after applying the CPI adjustment and rounding rule.
How the 2026 Arizona homestead amount is derived
Arizona 2026 homestead CPI adjustment The 2025 adjusted amount of four hundred twenty-five thousand two hundred dollars is increased by the August 2024 to August 2025 CPI increase and rounded up to the nearest one hundred dollars, producing four hundred thirty-seven thousand six hundred dollars. 2025 Amount $425,200 August CPI-U Change 314.796 → 323.976 about +2.9% 2026 Amount $437,600
Year Calculation Basis Adjusted Homestead Amount
2023 base Proposition 209 statutory base $400,000
2024 August 2022 → August 2023 CPI adjustment $414,700
2025 August 2023 → August 2024 CPI adjustment $425,200
2026 August 2024 → August 2025 CPI adjustment $437,600
Why does the Arizona statute still say $400,000? Because $400,000 is the statutory base. Subsection D separately requires the amount to be adjusted every January 1 for inflation and rounded up to the nearest $100.
Equity Tool

Arizona Homestead Exemption Calculator: Is Your Equity Within $437,600?

Arizona’s exemption protects equity, not the entire market value of the home. Use this tool to compare your estimated equity with the 2026 homestead amount.

Estimated Equity $0
Homestead Limit $0
Within Exemption $0
Equity Above Limit $0

Educational estimate only. A judicial sale analysis also depends on lien priority, actual property value, sale costs, the type of debt, recorded judgments and other applicable law.

Example: a $600,000 home with $250,000 owed on the mortgage has about $350,000 of equity. In 2026, that simple equity figure is below the $437,600 homestead amount.
Eligibility

Who Qualifies for the Arizona Homestead Exemption?

A.R.S. §33-1101 focuses on Arizona residents who are at least 18 and who actually reside in the qualifying home or shelter.

🎂

At least 18 years old

A qualifying claimant must be at least 18 years of age.

🌵

Arizona resident

The statute applies to a person who resides within Arizona.

🏠

Actually live in the home

The protected property must be a qualifying dwelling, condominium, cooperative or listed form of shelter in which the person resides.

Property / Situation Arizona Rule Practical Meaning
House and land Qualifying Interest in real property in one compact body with the dwelling house where the person resides.
Condominium Qualifying One condominium in which the claimant resides can qualify.
Cooperative Qualifying One cooperative in which the person resides can qualify.
Mobile / manufactured home Expressly listed Current §33-1101 includes mobile homes and manufactured homes in its shelter provision.
Park model trailer Expressly listed beginning under 2025 amendment Can be within the current shelter category when statutory requirements are satisfied.
Motor home / travel trailer / fifth wheel Expressly listed Arizona expanded the statute in 2025 to expressly cover these forms of shelter.
Houseboat Expressly listed Houseboats were added to the current statutory list of qualifying shelter types.
Vacation / investment property Not simply because you own it The statute requires residence in the property selected as the homestead.
Leased-land or unusual title arrangement? The current shelter provision refers to listed shelters plus the land on which the shelter is located. If you own a mobile home, RV-type dwelling or other shelter but do not own the underlying land, the exact ownership structure should be reviewed rather than assuming the full land-and-shelter protection applies.

Do You Fit the Basic Arizona Homestead Rules?

No Routine Declaration

Do You Have to File an Arizona Homestead Exemption?

Usually, no. A.R.S. §33-1102 says an entitled person holds the exemption by operation of law and no written claim or recording is required.

Normal homeowner

You live in one qualifying Arizona home and there is no dispute about which residence is your homestead.

Typical action: no homestead declaration needs to be recorded.

Creditor says more than one property could qualify

A creditor may demand that you designate the property protected by homestead.

Important: a 30-day response rule can apply after you receive the creditor’s certified-mail demand.
1

Read the creditor’s designation demand carefully

Section 33-1102 allows a creditor to demand a designation when you have more than one property interest to which a homestead could reasonably apply.

2

Identify the home you actually claim as homestead

Confirm the residence where you live and which property satisfies §33-1101.

3

Respond within 30 days

The statute allows the person to designate the property by recording a homestead exemption with the county recorder or by sending the creditor a certified letter, return receipt requested, within 30 days after receiving the demand.

4

Keep proof of your response

Preserve the certified-mail receipt, correspondence and any recorded document because the consequences of failing to respond can affect how the exemption later must be asserted.

Missed the 30-day response? Section 33-1102 states that after receiving a proper demand and failing to respond as provided, the person may only assert the homestead exemption by recording a claim in the county recorder’s office where the property is located.
Married Couples

Does a Married Couple Get Two Arizona Homestead Exemptions?

No. The Arizona homestead amount does not double merely because two spouses own or live in the home.

One married couple

Only one homestead exemption may be held by a married couple under §33-1101.

Equity cap is shared

The statutory value refers to the equity of the single person or married couple—not $437,600 for each spouse.

Divorce and same residence

If a formerly married couple lived together in the dwelling and later divorces, the total exemption for that residence to either or both persons does not exceed the applicable single homestead limit.

Judgments & Forced Sale

Can a Judgment Creditor Force the Sale of Your Arizona Home?

Potentially—but ordinary judgment creditors cannot simply ignore the homestead exemption. Arizona law limits a judicial sale to situations where enough equity exists beyond the protected homestead and higher-priority consensual liens.

Simplified Arizona judgment-creditor analysis
Arizona homestead judgment creditor sale process The home value is reduced by priority consensual liens, the homestead amount is protected, and a creditor may pursue a judicial sale only where sufficient excess equity and a sufficient bid exist under Arizona law. Home Value Determine equity Subtract Priority Mortgage / deeds of trust and other senior consensual liens Protect Homestead $437,600 2026 amount Excess Equity? Judicial sale may be possible only if sale rules are met

Equity within exemption

If the debtor’s interest does not exceed the homestead amount plus higher-priority consensual liens, §33-1105 does not provide an ordinary judgment creditor the excess-equity basis described for a judicial sale.

Equity exceeds exemption

A judgment creditor may seek a judicial sale where the debtor’s interest exceeds the homestead exemption plus consensual liens having priority to the judgment.

Sale still needs a sufficient bid

A bid cannot be accepted unless it exceeds the homestead amount, qualifying priority consensual liens and allowable sale costs.

The homeowner receives the homestead amount from qualifying judicial-sale proceeds before the ordinary judgment creditor receives the remaining proceeds under the statutory order.
Recorded Judgment Lien

Does Arizona Homestead Exemption Make a Judgment Lien Disappear?

No. Modern Arizona law allows recorded judgments to become liens on homestead property, while preserving the homeowner’s statutory homestead priority in the applicable equity.

The lien can attach

A.R.S. §33-964 generally makes a properly recorded judgment a lien on a judgment debtor’s real property in the county, including homestead property under current law.

Homestead still comes first in sale proceeds

On a sale of homestead property subject to a judgment lien, §33-964 generally directs payment of the homestead exemption to the debtor and payment of liens with priority over the judgment lien before the judgment creditor is paid from remaining proceeds.

Practical closing issue: even when your equity is protected, a recorded judgment may appear in a title search and create escrow/title questions. Arizona law contains procedures for partial release or extinguishment of judgment liens in qualifying homestead sales.
What Homestead Does Not Block

Debts and Liens That Can Override or Bypass Arizona Homestead Protection

The homestead exemption is powerful against many unsecured judgment creditors, but it is not a universal defense against every lien on the home.

🏦

Mortgage or deed of trust

A consensual lien—including a mortgage or deed of trust—is expressly outside the ordinary homestead protection of §33-1103.

🔨

Labor / material lien

A lien for labor or materials claimed under Arizona’s mechanics’-lien statute is an express exception.

👨‍👩‍👧

Support arrearages

Certain child-support and spousal-maintenance arrearage liens are expressly treated differently under §33-1103.

⚖️

Excess equity

A recorded civil judgment or other nonconsensual lien can reach equity above the applicable homestead amount, subject to Arizona’s sale and priority rules.

🏘️

HOA / condo common-expense liens

Arizona’s condominium and planned-community statutes state that qualifying common-expense liens are not subject to the homestead chapter. Current foreclosure thresholds and procedures should be reviewed separately.

🏛️

Tax and governmental liens

Federal and state tax collection rights can arise under separate statutes and priority rules. Do not assume §33-1101 automatically defeats a tax lien.

Mortgage foreclosure is the most common misunderstanding. Homestead protection does not erase the voluntary security interest you gave the lender when you signed a mortgage or deed of trust.
After You Sell

Arizona Homestead Protection for Sale Proceeds: The 18-Month Rule

Arizona’s homestead exemption can move from the home to identifiable cash proceeds after a voluntary or involuntary sale.

Automatic The exemption attaches to qualifying identifiable sale proceeds.
18 months Maximum statutory proceeds period after the sale.
Earlier end Protection ends earlier if you establish a new homestead with the proceeds.
No refi proceeds Identifiable cash received from refinancing is expressly excluded from this proceeds protection.
What happens to protected proceeds after an Arizona home sale?
Arizona homestead sale proceeds timeline A homeowner sells the homestead, identifiable sale proceeds inherit the homestead protection, and that protection lasts up to eighteen months or until a new homestead is established with the proceeds, whichever comes first. Homestead Sold Voluntary or involuntary Identifiable Cash Proceeds Protected up to exemption up to 18 months Protection Ends 18 months after sale OR new homestead established
Practical tip: because the statute protects identifiable proceeds, keeping clear closing statements, bank records and a traceable money trail can make it easier to establish where the protected sale funds went.
Cash-out refinance is different. Section 33-1101 specifically says the homestead exemption does not attach to identifiable cash proceeds from refinancing the homestead property.
Moving & Abandonment

When Do You Lose or Abandon an Arizona Homestead?

A.R.S. §33-1104 identifies several ways a homestead can be abandoned, but it also provides an important temporary-absence rule.

Recorded abandonment or waiver

A claimant can execute and acknowledge a declaration of abandonment or waiver. It becomes effective on recording in the county where the homestead is located.

Transfer of the property

Conveying the homestead can constitute abandonment, although Arizona includes an exception for certain transfers into a qualifying revocable trust controlled by the claimant.

Permanent removal

Permanent removal from the residence or from Arizona can constitute abandonment.

Temporary absence: §33-1104 allows a claimant to be away from the homestead for up to two years without the absence itself constituting abandonment or waiver.
Revocable trust rule: transferring the property into a trust does not constitute abandonment when the claimant retains the power to administer and revoke the trust as described by §33-1104(E).
Recent Law Changes

What Changed in Arizona Homestead Law for 2025–2026?

Two changes are especially important for a current 2026 guide: Arizona broadened the types of shelters covered by §33-1101 and added a bankruptcy-specific appreciation rule.

More dwelling types expressly listed

The current statute now expressly includes a mobile home, park model trailer, motor home, travel trailer, fifth wheel trailer, houseboat, manufactured home or other form of shelter in which the person resides, together with the land described by the statute.

Bankruptcy appreciation clarification

The current statute contains a new subsection F governing bankruptcy cases and protecting post-filing appreciation when the debtor’s equity is within the applicable homestead amount on the petition date.

Why the update matters: an Arizona homestead article that still discusses only a house, condo and mobile home—or that treats the bankruptcy exemption as frozen only to the original dollar amount of later appreciation—is incomplete for 2026.
Bankruptcy

How the Arizona Homestead Exemption Works in Bankruptcy

Arizona residents generally may not use the federal exemption list in 11 U.S.C. §522(d); Arizona has opted out under A.R.S. §33-1133. Bankruptcy, however, adds federal residency, timing, lien-avoidance and exemption rules that go beyond a simple state-law equity calculation.

Amount set at filing

Current §33-1101(F) says the debtor’s homestead exemption is initially determined as of the date the bankruptcy petition is filed.

Post-filing appreciation can remain protected

If the equity is less than or equal to the applicable homestead amount at filing, Arizona now says the homestead property is 100% exempt and an increase in value during the bankruptcy case remains 100% exempt even if the debtor’s interest later rises above the original cap.

Do not use the $437,600 calculator alone to decide whether a bankruptcy case is safe. Federal bankruptcy law can impose separate domicile and recently acquired homestead limitations, and recorded liens may require separate motions or analysis.

Arizona Homestead Does Not Cut Property Taxes—These Programs Might

Arizona Department of Revenue specifically describes the Title 33 homestead exemption as not a true property-tax exemption. Property-tax relief is handled through different programs, usually by the county assessor.

Senior Freeze

Arizona Senior Property Valuation Protection: 2026 Income Limits

This program is often called the “Senior Freeze.” It freezes the qualifying property’s valuation—not the final tax bill.

Basic eligibility

  • Arizona resident age 65 or older.
  • Primary residence.
  • At least two years in the residence before applying.
  • Application furnished to county assessor by September 1 for the current year.
  • Income test based on average total income during the previous three years.
  • Reapplication every three years.

2026 income thresholds

  • One owner: $47,712.
  • Two or more owners: $59,640.
  • Program income includes income from all sources, including specified nontaxable income.

These 2026 amounts reflect the constitutional formula tied to the federal Supplemental Security Income benefit rate.

Senior Freeze does not freeze the tax bill. Tax rates can change even while the protected valuation remains fixed.

2026 Personal Exemptions

Widow, Disabled Person & Disabled Veteran Property-Tax Exemptions

Arizona’s individual exemptions are separate from homestead protection and generally require an application through the county assessor.

Widow / Widower

Qualifying Arizona widows and widowers may receive a partial exemption subject to household-income and assessed-value limitations.

Total & Permanent Disability

Qualifying residents may receive a partial exemption after meeting the statutory income/value requirements and disability-certification requirements.

Disabled Veteran

Beginning with the updated 2026 rules, qualifying veterans can receive disability-rating-based relief, while a qualifying veteran with a 100% service-connected VA disability may receive a full exemption of the primary residence when all statutory requirements are met.

2026 Figure Amount What It Applies To
Indexed personal exemption base $4,873 Used for qualifying personal exemptions; veteran amounts below 100% can be prorated by disability percentage.
Household income — no qualifying child $39,865 Current 2026 personal-exemption income test.
Household income — qualifying minor / disabled child $47,826 Higher household-income ceiling in the qualifying-child category.
100% service-connected disabled veteran Potential full primary-residence exemption Subject to statutory qualification, income rules and county-assessor approval.
Application window: Arizona’s ordinary personal-exemption filing period generally runs from the first Monday in January through March 1. County procedures can allow a later filing accompanied by an exemption-deadline waiver in qualifying circumstances.

Troubleshooting

Arizona Homestead Problems: What to Do Next

I never filed a homestead form

That is normal in Arizona. The exemption generally arises automatically.

Next: verify that you satisfy §33-1101 and actually reside in the qualifying property.

A judgment appears on my title report

Modern Arizona law allows a recorded judgment lien to attach to homestead property even though the protected equity receives statutory priority.

Next: identify the judgment recording date, amount, senior liens, sale price and expected net equity.

A creditor sent me a letter asking which property is my homestead

This may trigger the §33-1102 designation procedure.

Next: calendar the 30-day period immediately and preserve the certified-mail documentation.

I am selling the house while a judgment exists

Homestead priority and judgment-lien release procedures can affect escrow.

Next: provide the title company with the judgment information early rather than discovering it immediately before closing.

I sold the house and have the cash

Identifiable proceeds can remain protected for up to 18 months or until a new homestead is established with them, whichever comes first.

Next: preserve a clear record tracing the closing proceeds.

I took cash out in a refinance

Arizona expressly excludes refinancing proceeds from the sale-proceeds homestead protection.

Next: do not treat cash-out refinance money as automatically protected homestead proceeds.

I moved out temporarily

Arizona allows an absence of up to two years without the absence itself constituting abandonment.

Next: document the temporary nature of the absence and avoid conduct showing permanent abandonment if protection matters.

I want a property-tax discount

The Arizona homestead statute is not the program you need.

Next: review Senior Valuation Protection, personal exemptions and primary-residence classification with your county assessor.

The 2026 inflation-adjusted Arizona homestead exemption is $437,600. Arizona Revised Statutes §33-1101 contains a $400,000 base and requires annual CPI-U adjustments beginning January 1, 2024.

Do I have to file for Arizona homestead exemption?

Usually no. A.R.S. §33-1102 provides that an eligible person holds the homestead exemption by operation of law and no written claim or recording is ordinarily required.

Does Arizona homestead exemption lower property taxes?

No. Arizona’s Title 33 homestead exemption is creditor and home-equity protection, not a general property-tax exemption. Separate property-tax relief programs are available for some seniors, widows, widowers, disabled persons and disabled veterans.

How much equity does Arizona homestead protect?

Up to the applicable annual homestead amount. For 2026, that amount is $437,600. Equity generally means the value of the owner’s interest after relevant secured liens are considered.

Can a judgment creditor force the sale of my Arizona home?

Potentially, but A.R.S. §33-1105 allows an ordinary judgment creditor to pursue a judicial sale only where the debtor’s interest exceeds the homestead amount plus qualifying priority consensual liens, and the sale must produce a sufficient bid under the statute.

Does Arizona homestead exemption stop mortgage foreclosure?

No. A mortgage or deed of trust is a consensual lien and is expressly outside the ordinary homestead protection under A.R.S. §33-1103.

Does a married couple get two $437,600 homestead exemptions?

No. Only one homestead exemption may be held by a married couple, and the statutory value refers to the couple’s protected equity rather than a separate exemption for each spouse.

How long are Arizona homestead sale proceeds protected?

Identifiable cash proceeds from a voluntary or involuntary sale are protected for up to 18 months after the sale or until the person establishes a new homestead with the proceeds, whichever occurs first.

Are cash-out refinance proceeds protected by Arizona homestead?

No. A.R.S. §33-1101 expressly states that the homestead exemption does not attach to identifiable cash proceeds from refinancing the homestead property.

Can I move out temporarily without losing Arizona homestead protection?

Arizona law provides that a claimant may be removed from the homestead for up to two years without the absence itself constituting abandonment or waiver.

Can an RV, travel trailer or houseboat qualify for Arizona homestead protection?

Current Arizona law expressly lists park model trailers, motor homes, travel trailers, fifth wheel trailers, houseboats, manufactured homes, mobile homes and other forms of shelter in its homestead provision, subject to the statute’s residence and property-interest requirements.

What is the Arizona Senior Freeze income limit for 2026?

For 2026, the income threshold is $47,712 for property owned by one person and $59,640 where property is owned by two or more persons. Income is reviewed using the program’s three-year averaging rules.

Can a 100% service-connected disabled veteran get a full Arizona property-tax exemption?

Under Arizona’s updated rules applicable beginning with tax year 2026, a qualifying honorably discharged veteran with a 100% service-connected VA disability can receive a full exemption of the qualifying primary residence when all statutory requirements, including applicable income requirements, are satisfied.

Does Arizona homestead exemption apply in bankruptcy?

Arizona’s homestead exemption can apply in bankruptcy, and the current statute determines the exemption initially as of the petition date. If the debtor’s equity is within the exemption amount at filing, Arizona law now protects later appreciation during the bankruptcy case under the conditions stated in §33-1101(F). Federal bankruptcy rules can still affect eligibility and lien treatment.
